Terms of engagement
What the appointment letter will say
The Architects Code requires written terms before any work starts. Here is the substance of ours, so there is nothing to discover after you have committed.
| Clause | What it says |
|---|---|
| Scope of services | The RIBA stages we are appointed for, listed individually, and an explicit list of what is excluded — typically structural design, cost consultancy, party wall awards and measured surveys of anything we have not measured ourselves. |
| Fee and basis | The basis (percentage, fixed or time charge), the figure, what triggers each instalment, and the hourly rates for anything outside scope. VAT shown separately. |
| Other consultants | Who else you will need to appoint, with our estimate of each, and whether we or you are appointing them. |
| Liability | Our liability is limited to the level of our professional indemnity cover, £2,000,000 each and every claim, and to our proportionate share where others are also responsible. |
| Insurance | PI certificate attached to the proposal. We undertake to maintain cover for six years after completion. |
| Copyright | We retain copyright in the drawings; you get a licence to use them for the project, which becomes irrevocable once fees are paid. |
| Suspension & termination | Either side may terminate on 14 days' written notice. You pay for work done to that point and nothing more; there is no cancellation charge. |
| Dispute resolution | Complaints procedure first, then mediation, then adjudication. Governed by the law of England and Wales. |

Companies House →The complaints procedure, in full
1. Tell us. In writing, to either director, at studio@fellmarlow.co.uk or the studio address. You do not need to use the word "complaint" or any particular form of words.
2. We acknowledge within 10 working days. In writing, naming the director who will deal with it — which will not be the person the complaint is about, unless we are both involved, in which case we say so.
3. We respond within 30 working days. A written answer setting out what we found, what we accept, what we do not, and what we propose to do. If we need longer we will tell you why and give a date.
4. If you are not satisfied. You may refer the matter to the Architects Registration Board, which regulates our conduct under the Architects Act 1997, or to the RIBA under its Code of Professional Conduct. Both are independent of us, and neither costs you anything.
This procedure is a requirement of RIBA Chartered Practice status, and having one is a requirement of the Architects Code. Publishing it is not — but a procedure nobody can read is not much use to the person who needs it.
Or simply ring
A director answers, or rings you back the same day
There is no reception and no enquiries team. Between 8.30 and 5.30, one of the two of us picks up.
